Why are new cars scrapped?

This happens for two reasons:

What kind of car can I rent out?

Anything that is outdated, faulty, or its restoration and maintenance will cost more than a modest remuneration when it is sold or scrapped.

Typically, vehicles over 20 years old, as well as cars damaged in an accident that cannot be restored, are handed over for recycling. It is also possible to hand over dismantled vehicles, but in this case it will not always be possible to receive a discount on recycling under the state program.

Is it possible to buy a salvaged car?

“Excuse me! - one of the readers will say. - How is this possible? After all, scrapped cars are dismantled and recycled!” It's not that simple!

In accordance with Order of the Ministry of Internal Affairs of the Russian Federation No. 1001 of November 24, 2008, it is impossible to restore the registration of a scrapped car. But this only applies to those cars that ended up at recycling points. If the car is not included there, it is quite possible to register it. Therefore, a certificate received from the traffic police does not mean that the car will soon be at the collection point. Many owners receive this document only to avoid paying taxes on a vehicle that they do not use. And some are also trying to make money by selling it.

If you deliberately wanted to purchase a salvaged car (prices for such cars are usually one and a half to two times lower than the market average), then by and large there is nothing wrong with such a purchase. The main thing is to know how to register a scrapped car.

Recycling to get a discount when buying a new car

Since 2010, the car recycling program has gained increased popularity, under which citizens who scrapped their old car received a substantial discount of 50 to 110 thousand rubles on the purchase of a new domestically produced or assembled car.

Officially, at the moment, the document for this program is not valid, however, a number of car dealers still provide a discount when scrapping an old car through dealerships or specialized centers. However, not every car can be traded in under this program to receive a discount - the car must meet a number of requirements. You can write off a car simply so that it is not registered as a citizen in any condition.

Basic conditions for recycling an old car to receive a discount:

  • the owner of the car is a citizen of the Russian Federation, and the car has been owned for at least a year;
  • the vehicle is at least 10 years old and the total weight cannot exceed 3.5 tons;
  • all documents are in perfect order, there is a title, there are no discrepancies in unit numbers;
  • the vehicle meets the technical condition requirements that apply when handing over a vehicle for recycling.

What are the technical requirements for the car?

To hand over an old vehicle under the recycling program, it is not at all necessary that the car be able to move independently. There are also no requirements for its good condition, but the car must have all the main components and assemblies, including:

  • engine;
  • transmission,
  • glazing and body elements,
  • dashboard;
  • battery and electrical equipment;
  • wheels;
  • technical fluids.

Such requirements are established mainly by dealers in order to avoid formal disposal of auto junk, consisting of a body frame and a pair of wheels. But the program itself does not resolve the issues of completing the scrapped vehicle.

How to restore documents if the car is scrapped

To apply for vehicle registration, you must contact the traffic police with the following documents in hand:

  • certificate of disposal;
  • power of attorney from the owner in writing (it is not necessary to go to a notary);
  • photocopies of passports (yours and the seller’s);
  • insurance;
  • maintenance ticket.

After checking the submitted papers, you will be given an application (of course you need to fill it out) and a payment slip for 3.3 thousand rubles. Next, you need to pay the state fee and, attaching the receipt received from the bank to the rest of the documents, visit the traffic police again to receive a PTS and a registration certificate. With a successful combination of circumstances, you can do it in 1-2 days. Then a standard DCP (purchase and sale agreement) is drawn up, and you are the full owner of a legally registered car.

Cost of scrapping a car

Taking a car for recycling costs several thousand rubles and depends on the chosen recycling point.

However, for all vehicles put into circulation after September 1, 2012, the recycling fee has already been paid. A note about this is placed in the vehicle passport (PTS). There is no need to pay extra for the disposal of such vehicles. Those. The car must be disposed of free of charge .

Third option

Option with trade-in

To increase demand and increase sales, automakers are introducing recycling or trade-in programs, under which owners can hand over their old cars and receive new ones at a significant discount (from 50,000 rubles to 350,000 rubles, depending on the characteristics of the car) in accordance with the terms of the promotion and special offers.

In 2010-2011 drivers who owned the car for more than a year could return it and receive a discount of 50,000 rubles. for a new car. In this case, the age of the car must be more than 10 years, and its weight must be up to 3.5 tons, according to the rules from Government Decree No. 1194 of December 31, 2009.

Currently, such a state program is not in effect, but drivers can return their old cars to a car dealership. Then it will be handed over for recycling or resold, and the motorist will buy a new one at a discount. A similar system is called trade-in. It has existed abroad for a long time, but in Russia it began to actively spread only in the last ten years. In this case, the owner must comply with the following conditions:

  • the car was owned for at least 1 year;
  • the car is more than 6 years old, otherwise it can only be sold;
  • the vehicle contains all the parts for its movement, and the driver has the right to remove the radio, navigator and other electronics.

At Nissan dealerships, using this system, you can choose a discount of 30,000 rubles. for a new car, reduction in CASCO price for 1 year or up to minus 2% per annum on the loan. It is the recycling of old cars that is offered by Skoda, whose discounts for such a program vary from 40,000 rubles. up to 115,000 rub. - depending on the brand of car.

At the same time, lawyer and auto lawyer Sergei Radko advises not to sell the car to various kinds of resellers who promise to dispose of it themselves. According to him, such cars are often restored and sold, or the documents for them are used to legalize another car: stolen or not cleared through customs. In such cases, the car continues to be registered with the seller, guaranteeing him troubles: the accrual of transport tax, fines or financial liability in case of an accident.

What controversial situations may arise when disposing of a car?

As a rule, owners of scrapped cars go to court if they continue to be charged transport tax on a car that no longer exists or because of incorrect recycling and the inability to deregister the car with the traffic police.

Thus, Ivan Popov* appealed to the Kalininsky District Court of the city of Ufa of the Republic of Bashkortostan with a claim to recognize the recycling act as valid and to deregister the car against JSC Bashtormet and the State Traffic Safety Inspectorate. Popov explained that he got into an accident, severely wrecked the car, and decided to scrap it. His son did this. He turned to an employee of JSC Bashtormet, who accepted the car as black scrap, destroyed it and issued an acceptance certificate. Subsequently, Popov found out that his relative was helped not by an employee of the recycling organization, but by an entrepreneur who issued an invalid document. For this reason, traffic police officers refused to deregister the car. In addition, Popov had to pay transport tax, and he also did not receive compensation for scrapping the car. Therefore, the plaintiff asked to recover from the defendants compensation in the amount of 38,049 rubles, compensation for moral damage, which he estimated at 25,000 rubles.

During the court hearing, Judge Oksana Bikchurina examined two original acceptance certificates (plaintiff and defendant) and found differences in them. Thus, Popov’s document was drawn up in violation of the requirements of GOST 2787-75. It incorrectly indicates the percentage of metal contamination (9% instead of 50%), there is no VIN of the car, therefore it is impossible to determine that Popov’s car was scrapped. The defendant's report did not contain a description of the car at all. Therefore, these acts were not enough to deregister the vehicle, and the court rejected Popov’s request. The decision was not appealed (case No. 2-642/2020).

In another case, MIFTS of Russia No. 13 for the Rostov region filed a claim with the Novocherkassk City Court of the Rostov Region to recover transport tax from Dmitry Lunev*, which he has not paid since 2014. At the court hearing, the defendant insisted that he disposed of the car back in 2010 and deregistered it with the traffic police, so he has no tax debts.

Judge Olga Vlasova requested information about the registration of Lunev’s car. According to the registration card, the vehicle is still registered to the plaintiff, but Lunev did not hand over the documents, license plates and title of the car to the traffic police after allegedly disposing of it. The court recovered the tax debt from the plaintiff. He did not appeal the decision, agreeing with it (case No. 2a-493/2020).

The new owner has the right to perform these actions on behalf of the seller by proxy. It is better to go to court with a new claim to recover the cost of the destroyed car from the ex-spouse. After all, it is actually impossible to use the car for its intended purpose, since this requires state registration.

Is it possible to drive a scrapped car?

The Code of Administrative Offenses of the Russian Federation does not provide for any special punishment for driving a scrapped car. However, for a number of reasons, such a ride can cost a pretty penny. Including, in accordance with Art. 12 of the Code of Administrative Offences, driving an unregistered car will cost 500 rubles. Repeated violation will increase the fine to 5 thousand rubles. Also, traffic police officers will have every right to send the car to the impound lot. How is the procedure performed?

The procedure for deregistering a car for recycling is quite simple; any citizen can handle it without the involvement of intermediaries. You just need to follow the established procedure, which is as follows:

Only those documents that are available are provided to the traffic police for vehicle disposal. If they were stolen, lost or transferred to the buyer, then only a passport will be sufficient. Certificate of disposal
